This is the agreement between you and Haze Tech Solutions LLC for using Haze Fax. Using the service means you accept it.

What the service is

Haze Fax sends and receives faxes over the telephone network, stores what was sent and received, and produces a receipt for each one. It also sends documents to be signed electronically.

Your account

You are responsible for what happens under your login, so keep the password to yourself. Tell us at once if you think somebody else has it. One person or organisation per workspace; do not resell access to it.

What you may not send

Fax is subject to real law, and this is the part with teeth. You must not use Haze Fax to send unsolicited advertising. In the United States the Telephone Consumer Protection Act makes an unsolicited advertising fax unlawful, with statutory damages per page, and the liability is yours. You must also not use it for anything fraudulent, harassing, or otherwise unlawful, and you must not send anything you have no right to send.

We may suspend an account we believe is doing any of that, without notice, because the alternative is carrying the traffic while it happens.

Paying

• Line is $12.00 a month and includes 300 pages and 1 fax number.
• Office is $29.00 a month and includes 1,000 pages and 3 fax numbers.
• Both begin with 3 days free. Your card is taken at the start and charged when the trial ends, unless you cancel before then.
• Past the monthly allowance, pages continue at 5 cents a page on Line and 4 cents a page on Office, and appear on the next invoice. Sending stops when it reaches the monthly limit you set, which exists so a mistake cannot become an invoice nobody agreed to.
• A fax the far end never answered does not count against your allowance and is not charged for.
• Subscriptions renew monthly until cancelled. Cancelling stops the next charge; it does not refund the month you are in.

Fax numbers

A number on your account is rented from a carrier, not owned by you. When you release it or close your account it goes back and somebody else may be given it. Numbers cannot be used for emergency calling, and Haze Fax is not a telephone service.

Electronic signatures

Signatures collected through Haze Fax are intended to satisfy the United States ESIGN Act and comparable state law, and we store the evidence that supports one: who signed, when, from where, and what they saw. Whether a particular document is legally binding depends on that document and on where you are, and this is not legal advice about it.

What we do not promise

A fax depends on telephone lines, on a carrier, and on a machine at the other end answering. We will do our part properly, but we cannot promise every fax arrives, and we do not promise the service is never interrupted. The service is provided as it is, without warranties of any kind.

Our total liability to you for any claim is limited to what you paid us in the twelve months before it arose. We are not liable for indirect or consequential losses, including lost business or lost profits, arising from a fax that did not arrive or did not arrive on time. If that limit does not suit what you are sending, use a courier as well.

Ending it

You may close your account at any time from Settings, which deletes everything in it immediately. We may end this agreement if you break these terms, or on thirty days notice for any other reason, in which case we will refund the unused part of the month.

Changes

We may change these terms. If a change matters, we will tell you in the app before it takes effect rather than editing the date at the top.

Law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules.
